About These Terms
These terms apply when you use the Crossbow Coffee Roasters website, create an account, or purchase products, gift cards, or subscriptions from us. By using the website or placing an order, you agree to these terms. If you do not agree, please do not use the website. You can contact us at orders@crossbowcoffee.nz.
Accounts and Acceptable Use
You must provide accurate, current information and keep your password confidential. You are responsible for activity under your account and should contact us promptly if you suspect unauthorised use. You must not misuse the website, interfere with its operation, attempt unauthorised access, introduce malicious code, scrape it in a way that disrupts the service, or use it for unlawful or fraudulent purposes. We may suspend access where reasonably necessary to protect customers, the website, or our business.
Products, Availability, and Orders
We try to keep product descriptions, images, prices, stock, and availability accurate, but minor variations may occur and coffee is a natural product. Placing an order is an offer to buy. An order is accepted when we confirm it and can fulfil it. We may reject or cancel an order before fulfilment if an item is unavailable, information or pricing is materially incorrect, payment is not authorised, or we reasonably suspect fraud or misuse. If we cancel an amount already paid, we will refund it to the original payment method or otherwise arrange an appropriate refund.
Prices and Payment
- Prices are shown in New Zealand dollars unless we clearly state otherwise.
- GST, delivery charges, discounts, gift-card credits, and any disclosed payment processing fee are calculated and shown at checkout before you place the order.
- Card payments are securely processed by Stripe. You authorise Stripe and us to process the amount shown at checkout and, for a subscription, future recurring charges.
- We may correct an obvious pricing or calculation error before accepting an order. We will give you the choice to proceed at the corrected price or cancel.
Delivery
Available delivery methods and charges depend on the address and products in your cart and are displayed at checkout. Delivery estimates are estimates, not guarantees. Please provide a complete, accessible delivery address. Contact us promptly if an order is delayed, missing, damaged, or incorrectly delivered so we can investigate and provide any remedy required by law.
Subscriptions
A subscription renews automatically at the interval and price shown when you subscribe. Each renewal may also include the disclosed recurring delivery charge, GST, and any fee shown at checkout. You authorise us to charge the saved Stripe payment method without requiring you to be online for each renewal. Renewal timing may move slightly where reasonably necessary for processing or calendar dates.
You can cancel an active subscription from your account or by contacting us before its next billing date. Cancellation stops future renewals but does not reverse a charge or order already processed. If a recurring payment fails, we may retry it, contact you, pause or cancel the subscription, or mark it past due. We will tell you before making a material change to an active subscription price or frequency and give you a reasonable opportunity to cancel.
Gift Cards and Discount Codes
Gift cards may be used for eligible purchases up to their remaining balance. They cannot be used to buy another gift card and are not redeemable for cash except where required by law. The purchaser is responsible for providing the correct recipient email address. Keep gift-card and discount codes secure; anyone with a valid code may be able to use it. Any expiry date, product restriction, minimum spend, usage limit, or other promotion term displayed when a code is issued also applies. We may disable a code obtained or used fraudulently or in breach of its stated conditions.
Returns, Refunds, and Consumer Rights
Our goods and services come with rights and guarantees that cannot be excluded under the New Zealand Consumer Guarantees Act 1993 and Fair Trading Act 1986. If a product is faulty, damaged, unsafe, not as described, or otherwise fails a legal guarantee, you may be entitled to a repair, replacement, refund, or other remedy. Nothing in these terms limits those rights.
We are not required to provide a refund simply because you change your mind, although we may agree to one at our discretion. For coffee and other perishable goods, contact us as soon as reasonably possible and keep the product and packaging where practical so we can assess the issue.
Website Content and Third-Party Services
The website and its text, branding, graphics, photographs, and software are owned by or licensed to Crossbow Coffee Roasters and may not be copied or commercially reused without permission, except as allowed by law. The website relies on third-party services, including Stripe, and may link to other websites. Their services and terms are outside our control.
Liability
To the maximum extent permitted by law, we are not liable for loss caused by events outside our reasonable control, your misuse of the website or products, or unauthorised use of your account or gift-card code that was not caused by us. We do not exclude or limit liability where doing so would be unlawful, including liability and remedies that cannot be excluded under New Zealand consumer law.
Privacy
Our Privacy Policy explains how we collect and handle personal information and forms part of your use of this website.
Changes, Severability, and Governing Law
We may update these terms for future website use and purchases by publishing a revised version here. The terms that applied when an order was accepted continue to govern that order unless a change is required by law or you agree otherwise. If one part of these terms is unenforceable, the remaining parts continue to apply. These terms are governed by New Zealand law, and New Zealand courts have non-exclusive jurisdiction, subject to any rights you have to bring a claim elsewhere under applicable consumer law.
